Aujourd&rsquo;hui nous aborderons l&rsquo;obligation du d&eacute;fibrillateur. Chaque ann&eacute;e, environ 50&thinsp;000 Fran&ccedil;ais meurent subitement d&rsquo;un arr&ecirc;t cardiaque et du manque de personnes capables d&rsquo;intervenir qui auraient pu pratiquer les gestes de premiers secours, notamment avec une <a href=\"https:\/\/www.cse-guide.fr\/dae-defibrillateur-entreprise\/\">utilisation d&rsquo;un d&eacute;fibrillateur Automatis&eacute; Externe (DAE)<\/a>. On distingue deux grands types de d&eacute;fibrillateur, dont :<\/p>\n<ul>\n<li aria-level=\"1\">Le D&eacute;fibrillateur Enti&egrave;rement Automatique : un appareil qui envoie directement une d&eacute;charge &eacute;lectrique en cas de n&eacute;cessit&eacute; et sans l&rsquo;intervention d&rsquo;un utilisateur.<\/li>\n<li aria-level=\"1\">Le D&eacute;fibrillateur Semi-automatique : cet appareil d&eacute;livre directement le choc &eacute;lectrique apr&egrave;s qu&rsquo;un intervenant ait appuy&eacute; sur un bouton.<\/li>\n<\/ul>\n<p><br \/>D&rsquo;apr&egrave;s l&rsquo;Arr&ecirc;t&eacute; R. 6311-14, un d&eacute;fibrillateur qu&rsquo;il soit enti&egrave;rement automatique ou semi-automatique a pour fonction de :<\/p>\n<ul>\n<li aria-level=\"1\">Analyser automatiquement les activit&eacute;s &eacute;lectriques du myocarde d&rsquo;une personne victime d&rsquo;un arr&ecirc;t cardiaque. Il permet aussi d&rsquo;apercevoir une fibrillation ventriculaire ou des tachycardies ventriculaires.<\/li>\n<li aria-level=\"1\">Charger automatiquement l&rsquo;appareil lorsque l&rsquo;analyse effectu&eacute;e au pr&eacute;alable est positive et l&rsquo;intensit&eacute; de la d&eacute;livrance des chocs &eacute;lectriques externes transthoraciques est appropri&eacute;e. Cette activit&eacute; permet de restaurer l&rsquo;activit&eacute; circulatoire &agrave; chaque choc d&eacute;clench&eacute; par l&rsquo;utilisateur du d&eacute;fibrillateur.<\/li>\n<li aria-level=\"1\">Enregistrer les segments de l&rsquo;activit&eacute; &eacute;lectrique du myocarde et des donn&eacute;es de l&rsquo;utilisation de l&rsquo;appareil.<\/li>\n<\/ul>\n<p><br \/>En bref, le d&eacute;fibrillateur sert &agrave; r&eacute;animer le c&oelig;ur d&rsquo;une personne en cas d&rsquo;arr&ecirc;t cardiaque et &agrave; r&eacute;tablir la circulation sanguine par le biais d&rsquo;un choc &eacute;lectrique ou une d&eacute;fibrillation<strong>.<\/strong> Selon le <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/id\/JORFTEXT000000278696\/\">d&eacute;cret n&deg; 2007-705<\/a> du 4 mai 2007, toutes personnes m&ecirc;me non m&eacute;decins ont le droit d&rsquo;utiliser un d&eacute;fibrillateur en cas de n&eacute;cessit&eacute;. Le but &eacute;tant de r&eacute;duire au maximum le nombre de morts subites par arr&ecirc;ts cardiaques.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section d\u00e9fibrillateurs<\/strong> et les ERP, ces lois entrent en vigueur \u00e0 partir du :<\/p><p>\u00a0<\/p><ul><li>1er janvier 2020 pour les ERP de cat\u00e9gories\u00a01,2 et 3\u2009;<\/li><li>1er janvier 2021, pour les ERP de cat\u00e9gories\u00a04<\/li><li>1er janvier 2022 la plupart des ERP de cat\u00e9gorie\u00a05.<\/li><\/ul>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<section Elle s&rsquo;applique principalement aux &eacute;tablissements recevant du public (ERP), selon leur cat&eacute;gorie.<\/p>\n<p>Plus l&rsquo;&eacute;tablissement accueille de personnes ou de publics &agrave; risque, plus l&rsquo;obligation est stricte.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-bf05aee elementor-widget elementor-widget-heading\" data-id=\"bf05aee\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Obligation d\u2019\u00e9quipement dans les ERP, communes et \u00e9coles<\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-fdd3161 elementor-widget elementor-widget-text-editor\" data-id=\"fdd3161\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p>Depuis la loi d&rsquo;octobre 2016 (article R. 123-57 du Code de la construction et de l&rsquo;habitation), certains &eacute;tablissements recevant du public (ERP) comme les &eacute;coles, les mairies ou les parcs d&rsquo;attraction doivent obligatoirement &ecirc;tre &eacute;quip&eacute;s d&rsquo;un <a href=\"https:\/\/www.drivecase.fr\/188-defibrillateurs-automatiques\">d&eacute;fibrillateur automatique externe<\/a> (DAE). Sont concern&eacute;s :<\/p>\n<ul>\n<li aria-level=\"1\">Cat&eacute;gorie 1 : ERP accueillant plus de 1 500 personnes<\/li>\n<li aria-level=\"1\">Cat&eacute;gorie 2 : de 701 &agrave; 1 500 personnes<\/li>\n<li aria-level=\"1\">Cat&eacute;gorie 3 : de 301 &agrave; 700 personnes<\/li>\n<li aria-level=\"1\">Cat&eacute;gorie 4 : moins de 300 personnes<\/li>\n<li aria-level=\"1\">Cat&eacute;gorie 5 : certains lieux &agrave; forte fr&eacute;quentation ou &agrave; risques sp&eacute;cifiques, comme :<br \/> &rarr; gares, centres commerciaux, salles de spectacles,<br \/> &rarr; &eacute;tablissements accueillant des personnes &acirc;g&eacute;es ou handicap&eacute;es,<br \/> &rarr; h&ocirc;tels, restaurants, refuges de montagne,<br \/> &rarr; stades, &eacute;tablissements sportifs<strong><br \/><br \/><\/strong><\/li>\n<\/ul>\n<p>Une signal&eacute;tique claire indiquant l&rsquo;emplacement du DAE est obligatoire. Les ERP dans un m&ecirc;me b&acirc;timent et plac&eacute;s sous une m&ecirc;me direction commune peuvent &eacute;galement faire une mutualisation selon l&rsquo;article R.123-21 du code de la construction et de l&rsquo;habitation, mais toujours selon les m&ecirc;mes conditions (facile et rapide d&rsquo;acc&egrave;s).<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section automatiques<\/strong> ou semi-automatiques. Toutefois, l&rsquo;employeur est oblig&eacute; d&rsquo;assurer la sant&eacute; et la s&eacute;curit&eacute; de ses salari&eacute;s. En cas d&rsquo;accident vasculaire et d&rsquo;absence de d&eacute;fibrillateur<strong>,<\/strong> il sera le seul responsable et devra assumer tout seul les cons&eacute;quences. Cela implique donc que les entreprises, et d&rsquo;ailleurs toutes personnes qui le souhaitent, sont libres de s&rsquo;&eacute;quiper d&rsquo;un DAE et de contribuer &agrave; sauver des vies.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-9b3637f elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"9b3637f\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-5116790\" data-id=\"5116790\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-7e398e3 elementor-widget elementor-widget-heading\" data-id=\"7e398e3\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Est-ce que la maintenance d\u2019un d\u00e9fibrillateur est obligatoire ?\n<\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-78315f2 elementor-widget elementor-widget-text-editor\" data-id=\"78315f2\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p>Conform\u00e9ment \u00e0 la loi d\u2019octobre 2016, les structures \u00e9quip\u00e9es d\u2019un d\u00e9fibrillateur, notamment les ERP, ont l\u2019obligation d\u2019en assurer la maintenance, ainsi que celle de ses accessoires.<\/p><p>\u00a0<\/p><p>L\u2019article L.123-6 pr\u00e9cise : \u00ab Les propri\u00e9taires des \u00e9tablissements mentionn\u00e9s \u00e0 l\u2019article R.123-57 sont tenus de s\u2019assurer de la maintenance du d\u00e9fibrillateur automatis\u00e9 externe et de ses accessoires, conform\u00e9ment aux dispositions de l\u2019article L.5212-1 du Code de la sant\u00e9 publique. \u00bb<\/p><p>\u00a0<\/p><p>Conform\u00e9ment \u00e0 l\u2019article R.5212-25 du code de la sant\u00e9 publique, la maintenance des d\u00e9fibrillateurs doit \u00eatre effectu\u00e9e par le fabricant lui-m\u00eame ou effectu\u00e9e sous sa supervision, ou par un fournisseur de tierce maintenance ou encore par un exploitant.<\/p><p>En cas de non-respect de cette obligation de maintenance des d\u00e9fibrillateurs<strong>,<\/strong> les propri\u00e9taires de l\u2019\u00e9tablissement recevant du public (ERP) sont tenus responsables des \u00e9ventuels accidents li\u00e9s aux crises cardiaques.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-fa3ed22 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"fa3ed22\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-6c5f19a\" data-id=\"6c5f19a\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-43344fa elementor-widget elementor-widget-heading\" data-id=\"43344fa\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Quelles sont les sanctions encourues si une structure concern\u00e9e de poss\u00e8de pas de d\u00e9fibrillateur ?\n<\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-40b00ed elementor-widget elementor-widget-text-editor\" data-id=\"40b00ed\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p>Chaque ERP est tenu de respecter les normes de s&eacute;curit&eacute; sp&eacute;cifi&eacute;es par sa classification. Le non-respect de ces derni&egrave;res l&rsquo;expose &agrave; de lourdes sanctions :<\/p>\n<ul>\n<li aria-level=\"1\">La fermeture administrative temporaire ou d&eacute;finitive de l&rsquo;&eacute;tablissement ordonn&eacute;e par le maire ou le pr&eacute;fet<\/li>\n<li aria-level=\"1\">Une amende pouvant aller jusqu&rsquo;&agrave; 45 000&euro; et une peine d&rsquo;emprisonnement<\/li>\n<\/ul>\n<p>De plus, un ERP d&eacute;pourvu de d&eacute;fibrillateur s&rsquo;expose aux plaintes des victimes d&rsquo;arr&ecirc;t cardiaque qui n&rsquo;auraient pas pu b&eacute;n&eacute;ficier de l&rsquo;aide n&eacute;cessaire. Toutefois, en cas de situation d&rsquo;urgence, il est pr&eacute;f&eacute;rable d&rsquo;avoir suivi une formation m&eacute;dicale ou une formation de secourisme. De cette mani&egrave;re, l&rsquo;utilisateur de l&rsquo;&eacute;quipement pourra conna&icirc;tre &agrave; l&rsquo;avance les bons gestes &agrave; adopter pour effectuer un massage cardiaque et pour augmenter les chances de survie d&rsquo;une personne victime d&rsquo;arr&ecirc;t cardiaque.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div
