La soci\u00e9t\u00e9 a un d\u00e9lai de 45 jours pour remplir un formulaire. Elle devra ensuite le renvoyer en lettre recommand\u00e9e avec accus\u00e9 de r\u00e9ception.\u00a0 Il faut \u00e9galement qu\u2019elle mentionne dans le formulaire les coordonn\u00e9es du salari\u00e9 et son num\u00e9ro de permis de conduire. Quand la d\u00e9claration est termin\u00e9e, le salari\u00e9 recevra la contravention \u00e0 son nom et devra payer l\u2019amende gr\u00e2ce \u00e0 ses fonds personnels.<\/p><p>Si le formulaire n\u2019est pas renvoy\u00e9 dans un d\u00e9lai de 45 jours suivant l\u2019avis de contravention, l\u2019entreprise doit payer une amende forfaitaire major\u00e9e. Les cons\u00e9quences d\u00e9pendent du type d\u2019infraction commise. Si le salari\u00e9 a un accident avec sa voiture de fonction, quelles que soient les circonstances, c\u2019est l\u2019assurance du v\u00e9hicule qui prend en charge les r\u00e9parations. De plus, l\u2019employeur n\u2019est pas en droit de licencier son salari\u00e9 \u00e0 cause d\u2019un accident avec un <b>v\u00e9hicule de soci\u00e9t\u00e9. <\/b>Pour limiter les d\u00e9marches administratives, vous pouvez proposer \u00e0 vos salari\u00e9s des <a href=\"https:\/\/www.drivecase.fr\/33-constat-amiable-personnalise\">constats amiables personnalis\u00e9s<\/a> en lien avec votre assurance.<\/p><p>Si celui-ci d\u00e9cide de lui retirer sa voiture de fonction, il faut absolument faire une modification sur le contrat du salari\u00e9. Il faut \u00e9galement demander l\u2019accord du salari\u00e9 au pr\u00e9alable. Si ce dernier refuse, l\u2018employeur ne peut pas lui retirer son v\u00e9hicule de soci\u00e9t\u00e9.
