L\u2019article R.233-83-3 du Code du Travail d\u00e9finit ainsi les EPI : \u00ab Un \u00e9quipement de protection individuelle (EPI) est un dispositif ou un moyen destin\u00e9 \u00e0 \u00eatre port\u00e9 ou tenu par une personne en vue de la prot\u00e9ger contre un ou plusieurs risques susceptibles de menacer sa sant\u00e9 ainsi que sa s\u00e9curit\u00e9. \u00bb<\/h2>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-d603950 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"d603950\" data-element_type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-143cb30\" data-id=\"143cb30\" data-element_type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t\t\t<div class=\"elementor-element elementor-element-53c7cb2 elementor-widget elementor-widget-text-editor\" data-id=\"53c7cb2\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p>Pour assurer une protection efficace aux travailleurs, le risque professionnel doit \u00eatre dans un premier temps rep\u00e9r\u00e9, analys\u00e9 et si possible \u00e9limin\u00e9 ou r\u00e9duit par la mise en place d\u2019une protection collective. Enfin, le risque r\u00e9siduel ou ponctuel sera alors pris en charge gr\u00e2ce \u00e0 la mise en place d\u2019<strong>EPI<\/strong>. Selon l\u2019<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006647502\" target=\"_blank\" rel=\"noopener\">article L. 230-2<\/a> du Code du Travail <em>\u00ab\u00a0L\u2019employeur prend les mesures n\u00e9cessaires pour assurer la s\u00e9curit\u00e9 et prot\u00e9ger la sant\u00e9 des travailleurs de l&rsquo;\u00e9tablissement, y compris les travailleurs temporaires. Ces mesures comprennent des actions de pr\u00e9vention des risques professionnels, d&rsquo;information et de formation ainsi que la mise en place d&rsquo;une organisation et de moyens adapt\u00e9s.\u00a0\u00bb<\/em><\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-32715a4 elementor-widget elementor-widget-text-editor\" data-id=\"32715a4\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p>C\u2019est donc l\u2019employeur qui prend en charge les <strong>EPI<\/strong> et qui se doit de mettre en place une d\u00e9marche de pr\u00e9vention des risques, et ce \u00e0 travers plusieurs obligations\u00a0:<\/p><ul><li>Analyser les risques au sein de l\u2019entreprise (pr\u00e9sence, fr\u00e9quence et gravit\u00e9), puis les renseigner dans le DUERP (Document unique d\u2019\u00e9valuation des risques professionnels). En effet, il n\u2019existe pas de texte pr\u00e9cis indiquant les <strong>EPI<\/strong> n\u00e9cessaires pour une activit\u00e9 donn\u00e9e. Par cons\u00e9quent, c\u2019est \u00e0 travers une analyse pr\u00e9alable que les employeurs pourront proposer des <strong>EPI<\/strong> adapt\u00e9s \u00e0 leurs salari\u00e9s. Ce choix se fera en fonction des risques \u00e0 \u00e9viter, des conditions de travail de l\u2019utilisateur de mani\u00e8re tr\u00e8s pr\u00e9cise (selon les t\u00e2ches effectu\u00e9es, la composition des produits utilis\u00e9s, les normes en vigueur\u2026). Le choix des <strong>\u00e9quipements de protection individuelle<\/strong> peut aussi \u00eatre effectu\u00e9 apr\u00e8s avoir consult\u00e9 le m\u00e9decin du travail pour \u00eatre certain des performances offertes par chaque v\u00eatement.<br \/><br \/><\/li><\/ul><ul><li>Mettre en place des actions pr\u00e9ventives ainsi que des modes op\u00e9ratoires permettant aux travailleurs d\u2019utiliser leurs<strong> EPI<\/strong> dans des conditions optimales de protection, et \u00e0 terme \u00e9liminer le risque, ou du moins l\u2019\u00e9loigner autant que possible.<\/li><\/ul>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d468d9e elementor-widget elementor-widget-text-editor\" data-id=\"d468d9e\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<ul><li>Fournir gratuitement et personnellement \u00e0 chaque employ\u00e9 les <strong>EPI<\/strong> adapt\u00e9s aux t\u00e2ches \u00e0 r\u00e9aliser, contr\u00f4ler l\u2019efficacit\u00e9 des tenues mises \u00e0 disposition et veiller \u00e0 leur utilisation effective.<\/li><\/ul><ul><li>Informer et entrainer les travailleurs au port des <strong>\u00e9quipements de protection individuelles. <\/strong>En effet, l\u2019employeur doit renseigner \u00e0 ses salari\u00e9s les risques contre lesquels l\u2019<strong>EPI<\/strong> les prot\u00e8ge, ainsi que les consignes ou instructions relatives aux \u00e9quipements. Pour \u00eatre motiv\u00e9s \u00e0 porter leurs <strong>EPI<\/strong>, ces derniers doivent prendre conscience des risques de sant\u00e9s qu\u2019ils encourent. Chaque salari\u00e9 doit \u00e9galement conna\u00eetre les conditions d&rsquo;utilisation et de stockage des <strong>\u00e9quipements de protection individuelle.<\/strong> S&rsquo;il ne respecte pas les instructions d&rsquo;utilisation, il doit \u00e9galement \u00eatre conscient de ses responsabilit\u00e9s.<\/li><\/ul><ul><li>Dispenser une formation \u00e0 leurs salari\u00e9s, compl\u00e9t\u00e9e par une formation pratique au port des <strong>\u00e9quipements de protection individuelle<\/strong> de classe III, qui leur permettra d&rsquo;utiliser leur mat\u00e9riel en toute connaissance de cause.<\/li><\/ul>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-67e7a92 elementor-widget elementor-widget-heading\" data-id=\"67e7a92\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">EPI de cat\u00e9gorie 3 : entra\u00eenement et v\u00e9rifications<\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-adce7c5 elementor-widget elementor-widget-text-editor\" data-id=\"adce7c5\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p>Les <strong>EPI de cat\u00e9gorie 3<\/strong> prot\u00e8gent contre des risques graves ou mortels (chutes de hauteur, risques \u00e9lectriques, noyade, exposition aux agents chimiques, etc.). Leur gestion impose \u00e0 l\u2019employeur des mesures sp\u00e9cifiques : fournir une information claire et renforc\u00e9e, organiser des exercices pratiques d\u2019utilisation et assurer un entra\u00eenement p\u00e9riodique (ex. port d\u2019un harnais antichute avec syst\u00e8me d\u2019arr\u00eat des chutes, contr\u00f4le des ancrages, exercices de suspension).<\/p><p>\u00a0<\/p><p>L\u2019entreprise doit mettre en place des v\u00e9rifications adapt\u00e9es : contr\u00f4les visuels avant chaque usage, v\u00e9rifications p\u00e9riodiques consign\u00e9es dans un registre, disponibilit\u00e9 permanente des notices, tra\u00e7abilit\u00e9 du mat\u00e9riel (num\u00e9ro de s\u00e9rie, date de mise en service, dur\u00e9e de vie). Les remplacements doivent \u00eatre anticip\u00e9s en fin de dur\u00e9e de vie ou apr\u00e8s tout incident (chute, choc, contamination). Enfin, la compatibilit\u00e9 entre diff\u00e9rents EPI (par exemple harnais + gilet haute visibilit\u00e9 + casque) doit \u00eatre syst\u00e9matiquement contr\u00f4l\u00e9e.<\/p><p>Respecter ces exigences permet \u00e0 l\u2019employeur de garantir une protection r\u00e9elle aux salari\u00e9s, de r\u00e9duire les risques d\u2019erreur et de d\u00e9montrer une gestion conforme aux obligations l\u00e9gales.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section Le manque de port d&rsquo;<strong>EPI<\/strong> malgr\u00e9 leur mise \u00e0 disposition est souvent la cause d&rsquo;accidents du travail et le manque de confort des \u00e9quipements en est g\u00e9n\u00e9ralement la premi\u00e8re raison. En effet, si un \u00e9quipement est inconfortable, il est peu probable qu&rsquo;il soit utilis\u00e9. L\u2019achat, l\u2019entretien et le remplacement des EPI rel\u00e8vent exclusivement de l\u2019employeur ; en aucun cas ces frais ne peuvent \u00eatre imput\u00e9s au salari\u00e9. En cas d\u2019accident du travail li\u00e9 \u00e0 l\u2019absence d\u2019EPI, la responsabilit\u00e9 de l\u2019entreprise peut \u00eatre engag\u00e9e et la faute inexcusable recherch\u00e9e.
